1. Who we are

This website is operated by Elite AutoHaus (Pty) Ltd ("Elite AutoHaus", "we", "us"), a pre-owned luxury and performance vehicle dealer at 212 Bram Fischer Drive, Kensington B, Randburg, 2194. We are the responsible party for the personal information described in this policy.

2. What we collect

• Details you give us through our enquiry, finance, sell/trade-in and sourcing forms, by email, phone or WhatsApp: your name, phone number, email address, the vehicle you are interested in or want to sell (make, model, year, mileage) and anything you write in your message.
• Finance and purchase information if you go ahead with a finance application or a purchase, such as your ID number, proof of address, payslips and bank statements. We only ask for these when they are needed.
• Technical information that our hosting provider records automatically when you visit, such as your IP address, browser type and the pages requested, in standard server logs used for security and to keep the site running.

3. Why we use it

• To answer your enquiry and arrange viewings, test drives and deliveries.
• To value a car you want to sell or trade in, and to find a car you have asked us to source.
• To submit a finance application to banks and finance houses, only when you ask us to.
• To complete a sale and keep the records the law requires, for example under tax and consumer protection laws.
• To keep the website secure and working properly.

We process your information because you have given consent, because it is needed to take steps towards or to perform a contract with you, because the law requires it, or for our legitimate interest in running a safe and responsive business. We do not sell your personal information. We will only send you marketing if you have asked for it, and you can opt out at any time.

4. Who we share it with

• Banks and finance houses, when you ask us to arrange finance.
• Service providers who help us operate: our website host (Netlify), our form-handling service (FormSubmit), which passes your form submission to our email, and our email provider (Google Workspace).
• Transport and delivery partners, if we deliver a vehicle to you.
• Authorities, where the law requires it.

Some of these providers store information on servers outside South Africa. Where that happens, we use providers that are bound by data-protection laws or agreements that give a level of protection similar to POPIA, as section 72 of POPIA requires.

5. Third-party services on this website

Our pages load fonts from Google Fonts, and the contact page shows an embedded Google Map. When these load, Google receives your IP address and may set its own cookies; see Google's privacy policy. If you click a WhatsApp link, your conversation is handled by WhatsApp (Meta). Links to AutoTrader open AutoTrader's own website, which has its own privacy policy.

6. Cookies

This website does not set its own cookies and does not use analytics or advertising trackers. The embedded Google Map and Google Fonts may set or read cookies as described above.

7. How long we keep it

We keep enquiry details only as long as needed to deal with your enquiry and any follow-up, normally no longer than 24 months. Records of a sale or finance application are kept for as long as the law requires (for example, five years for tax records). After that, we delete or de-identify them.

8. How we protect it

We take reasonable technical and organisational measures to keep your information safe, including encrypted (HTTPS) connections to this website, access controls on our email and records, and only sharing information with people who need it. If we become aware of a security compromise affecting your information, we will notify you and the Information Regulator as POPIA requires.

9. Your rights

Under POPIA you may ask us to confirm whether we hold personal information about you and to give you access to it; ask us to correct or delete information that is inaccurate, out of date or no longer needed; object to processing, including direct marketing; and withdraw your consent at any time (this does not affect processing that already took place). To make a request, email our Information Officer at keiran@elite-autohaus.com. We may need to confirm your identity first. Requests for records may also be made under PAIA; see our PAIA notice.

10. Complaints

Please contact us first so we can try to resolve your concern.
